1984.02.22_PB_Minutes_WorkshopPage -1- '� MINUTES: PLANNING COMMISSION/LOCAL PLANNING AGENCY, TOWN OF HIGHLAND BEACH, FLORIDA. WORKSHOP/PUBY,IC HEARING FEBRUARY 22,1984 •Acting Chairman Irving S. Saunders, called the meeting to order at 9:30 a.m., advising this was a Workshop Meeting of the Planning Commission/ Local Planning Agency, Town of Highland Beach, Florida. The agenda is attached. The recording secretary called the roll. Present: R. F. Blosser, W. J. Wernecke, D. R. Rome, M. A. Waldman, I. S. Saunders. Absent: E. L. Snyder 10 The following representatives of Boca Hi were present: Mr. T. L. Delaney, Mr. Paul Stevens, Mr. John Buckley, Mr. Martin Perry, Mr. Mark Acting Chairman Saunders noted this Workshop Meeting was called for the purpose of continuing the consideration and request for approval of changes in plans for Boca Highland, RPUD, as has been submitted to the Planning Commission. Any petitioner who proposes to appeal a decision, will be provided with a verbatim record at a nominal cost. Mr. Saunders called upon Mr. Delaney to review the presentation. Mr. Delaney noted the "representatives present as the same team we had on this last stand. Having made this submission to you, we stand ready` to answer any questions the Planning Commission may have." Mrs. Rome noted that the plans did not indicate dimensions of rooms. Mr. Wernecke noted a two (2) tower concept was presented at the request of the Planning Commission and a plan showing fifteen (15) floors -- reduced from sixteen (16) floors, as previously proposed. Mr. Blosser noted that the sectional drawing of the Townhouses is missing from the plans. The two (2) story end units are Townhouses. Mr. Delaney indicated the tennis courts are for the use of the entire development. The marina provides access to all residents. Mr. Waldmia.n� asked if plans were to scale. Mr. Perry noted the Braemar Isle garage plans were corrected to scale. Mrs. Rome spoke of the differ- ence in outline of buildings. Density of units was noted by Mr. Delaney as follows: Braemar Isle - 43.3 units; Dalton Place - 42.03 units and B & C - 34.00 units. Acting Chairman Saunders noted he had been unable to locate drawings that the Boca Hi developers had been called upon to deliver. These require- ments included drawings showing locations, dimensions, intended use for each building or portion thereof, approximate total floor areas and res- idential floor areas of all proposed structures. WORKSHOP/PUBLIC HEARING FEBRUARY 22 1984 0 Mr. Delaney noted the beach facility plans have been revised and the concept plans reviewed in January and February. The drawing was shown at an evening presentation to Boca Hi residents. Following a discussion regarding guest parking, Mr. Delaney noted that with the resistance shown to the sales program for additional guest parking space, residents did not appear to be interested in purchasing extra parking spaces. Mr. Wernecke questioned why the plans of seventeen (17) stories now instead of sixteen (16) are superior to others that have been submitted. Mr. Perry indicated the two (2) tower concept was a specific response to a request by the Planning Commission to see what that type of approach would look like. Mr. Perry noted an effort was being made to the marina and the marina walk open for emjoymen t by all residents and added that the Townhouse configuration on the Intracoastal has not changed drama- tically. Mr. Stevens noted that"to go directly at your question about seventeen (17) floors, there are fifteen (15) living floors in those buildings, •over two (2) level parking". The three (3) tower scheme was sixteen (16) living floors. Mr. Blosser inquired about sectional drawings of the Townhouse plans. A general discussion relative to the Townhouse plans followed. Mr. Perry advised that at certain intervals in the center of the Intracoastal building, there is a Townhouse over a Townhouse, two (2) floors over two (2) floors. In other portions of the building there are four (4) apartments high, so it's a combination of the two. Mrs. Rome noted that during the eight and one half years changes had been made, buildings moved , and added that larger size apartments would be in order. Mr. Waldman inquired as to whether the buildings were to scale. Mr. Glyman noted they were. Mr. Blosser noted the square buildings appear- ance and indicated that the rounded corners were much better than the rectangle which were shown previously. Mrs. Rome indicated that"under petition for rezoning of the RPUD number one, the survey, we are not so interested in the core boring except when we get down to number six (6) site plan analysis sheets number seven (7) •preliminary master site plan and number eight (8) typical building plan number nine (9) height envelope. analysis, none of which we have." WORKSHOP/PUBLIC_IiEARING FEBRUARY 22,1984 Mr. Delaney noted that he had"delivered them here and they were attached • to, as it says in the Ordinance, that they are attached thereto, it says on the front page - The attachments referred to above shall be an integral part of the approval and so I assume that the attachments are with the original as it states here." Town Attorney Sliney noted that Mr. Delaney was referring to the original ordinances vis a vis the plans. Original ordinances are normally kept by the Town in a safe deposit box and indicated "that may be the answer to the ordinance question." Chairman Saunders spoke relative to the initial time that"the developer, namely Boca Hi, was submitting it's intentions to build an RPUD with good intentions and the Town Commission had somebody write up this Ordinance with good intentions and they.instructed them to submit all these preliminary drawings. From these preliminary drawings, someone, namely the Planning Commission, gave the Community Appearance Board, certainly the Town Com- mission after looking at these dimensional drawings and every building that was contemplated and put on that RPUD site, namely 26.2 acres should have been drawn to scale, dimension, how many stories, you can't hide these things, when it's two (2) stories, it's two '(2) stories. When it's four (4) stories, it's four (4) stories. And at that point we should have known, there should have been no surprises." Town Attorney Sliney noted • that these things should be a matter of record in the Building Department. Chairman Saunders noted he had contacted the Palm Beach County Zoning Department and learned that RPUD projects were not handled by that department. Chairman Saunders added that the Oliver -Hoffman project was in the wings. In reply to question by Mrs. Rome regarding the plans of the original layout Ma,, •DtJaney , said he did not have any thing other than the official map. Mr. Blosser read from a letter dated January 23, 1979, addressed to the Town Manager, title "BOCA HI, RPUD". It states in the final paragraph quote "It certainly is the intent of the Zoning Ordinance 336 but if for any reason the Boca Hi RPUD were at sometime in the future not to be ex- isting and in good standing as far as the Town of Highland Beach is cone cerned, that the property would be covered by the zoning category for which the zoning map, under 336 shows the property." "In other words",(I continue the quotation) "if the Boca Hi RPUD should at some time not be in good standing, then the property would be governed by zoning category RMM" (unless Ordinance 336 were in the meantime amended iswhich has not been, to my knowledge ) can be governed by the regulations applicable to any property zoned RMM." Page -4- ✓� MINUTES: PLANNING COMMISSION/LOCAL PLANNING AGENCY, TOWN OF HIGHLAND BEACH, FLORIDA. WORKSHOP / PUBLIC HEARING FEBRUARY 22,1984 •Town Manager Elaine W. Roberts gave a brief review of the history of the development of the Boca Hi project. Mrs. Roberts also discussed the placement of the Carron House and why it was turned backwards,"if you will". and in addition, discussed the matter of the Carron House and the use of the beach facilities. Mr. Delaney noted the Carron House was turned around one hundred and eighty (180) degrees so that Carron House could take advantage of the internal security of Boca Hi. In answer to question by Mr. Wernecke, Mr. Delaney Pointed out that the number 660 which the developers had arrived at "was not a magic number, very frankly, it was a number drawn from the air." Town Attorney Sliney suggested that members refer to Section 8.9 which is the thing "that we have been dealing with, it's Section 8.9.3, Admin- istration of Existing Residential RPUD'S." Mr. Delaney spoke regarding building heights, noting one site plan allows for one (1) foot for every three (3) feet back from AlA. Allowance is also made for every one (1) foot they are set back from the Intracoastal, and, Mr. Delaney noted, allowance of certain bonuses for cars underneath - an allowance of twenty (20) per cent penetration if the parking is under • the structure. Mr. Wernecke indicated a reluctance to approve two hundred and seventy two (272) units which would result in a total of eight hundred and twenty (820) units. Following a discussion regarding a recommendation by Town Attorney Sliney, that Planning Commission members submit a "laundry list" of questions, Mrs. Rome inquired as to whether Commission members wanted to walk the site after it has been staked. Members agreed to meet on Wednesday, March 7, 1984, at 9:30 a.m., at the Boca Highland Sales Center, for a field trip. Chairman Saunders advised members of the Commission that he will be at the Town Hall interviewing a Town Planner at 2:00 p.m. on Friday. Chairman Saunders advised that at this time the Commission would welcome comments from members of the audience.
