• RENOVATIONS AND ADDITION.
Chairman Irving S. Saunders called the meeting to order advising this was
a regular meeting of the Planning Commission/Local Planning Agency, Town
of Highland Beach, Florida. The agenda is attached. The recording sec-
retary called the roll. The meeting came to order at 9:30 a.m.
Present: I. S. Saunders, D. R. Rome, R. F. Blosser,
M. A. Waldman, J. E. Ward (Alt. ##1) , A. Leng (Alt. #2) .
Chairman Saunders advised the first order of business to be consideration
of a request for site plan review submitted on behalf of Rev. Edward A.
McCarthy, Archbishop of Miami, by Rev. Anthony J. Chapanis.

GENERAL INFORMATION:
Number of stories - 1 and 2. Length of building 204' - 211. Width of
building, rear 135' 11"; front 90'. Floor elevation is 8.1. Maximum
height of building 28' (including cross 35' 3"). Bell Tower height 50'.
Site area 204,167.25 sq. ft. (4.687 ac.). Church area 19,465.00 sq. ft.
Percent of coverage is 9.53/. Total parking spaces is 227.
•Mr. Blosser questioned the need for a public hearing for site plan reviews.
Following reading by Mr. Blosser of Sec. 10, (b) "Site Plan Requirements",
it was determined site plan reviews did not require a public hearing, ac-
cording to Chapter 30. Building Official Bruce Sutherland outlined the
procedure for reviewing a site plan. Following Mr. Sutherland's outline,
members agreed to postpone the review until the arrival of Rev. Anthony
J. Chapanis.
Mrs. Rome spoke about information that should be -included on copies
of the agenda distributed prior to Planning Commission Meetings. Chair-
man Saunders advised the Commission that future copies of the proposed
agenda for each meeting will include all information submitted for con-
sideration by the applicant; and that Old Business, if being considered,
would be included, as well.
Chairman Saunders noted the appointment of Mr. John E. Ward, (Alt. #1).
Members were advised by Chairman Saunders that he had been informed by
Town Manager Elaine W. Roberts that the Community Appearance Board is
to be given plans with the necessary approval for "BRAEMER ISLE TOWN-
HOUSES" (Spaces & Places) project, provided by members of the Planning
Commission. Following discussion with Attorney David Friedman and
•members of the Commission, Mrs. Rome made the following MOTION: "The
Planning Commission hereby the landscaping plan for "BRAEMER
ISLE TOWNHOUSES" (Spaces & Places) only for the area of the buildings
that have so far been erected, in order for the C.A.B. to go ahead with
their landscaping approval". Mr. Waldman seconded the MOTION. Mr.
Blosser voted aye; Mr. Ward, aye; Mrs. Rome, aye; Mr. Waldman, aye; and
Chairman Saunders, aye.

In reply to question by Community Appearance Board Chairman Nita C. Martin,
in audience, Town Building Official Bruce Sutherland advised he will no-
tify the representatives of "BRAEMER ISLE TOWNHOUSES" (Spaces & Places),
regarding the approval of plans.
Following a five minutes recess, Mr. Saunders noted the next order of
business was examination of the application made by St. Lucy's Church
for renovations and additions to the existing structure on Lots 85 &
88 West. Mr. Saunders noted that Building Official Bruce Sutherland
has advised the members of the Planning Commission of the concept of
proposed enlargement of the Church utilizing the existing structure
to the rear and to the sides. The parking facilities will be able to
take care of the large seating capacity.
Following introduction by Mr. Saunders, Rev. Anthony J. Chapanis re-
viewed plans submitted for approval. Mr. Saunders indicated he found
no objection to the plan except for the concern of the access to the
rear, this is beyond the jurisdiction of the Planning Commission and
should be under the Fire Marshall's jurisdiction. Mr. Saunders sug-
gested that a fire hydrant be incorporated in the rear in the possibi-
• lity of a pump which might generate its water from the Intracoastal,
to counteract the inaccessibility of fire engines around the rear of
the Church.
At the conclusion of the examination of plans, Mr. Waldman offered the
MOTION "assuming that this meets with the Fire Marshall's approval,
that we go on record as ok'ing these plans". Mrs. Rome added, "I would
like to add to this that we suggest that a fire hydrant be placed in
the back of the new edifice where the rip rap wall will be placed".
Mr. Saunders seconded the MOTION. Mr. Blosser voted aye; Mr. Ward, aye;
Mrs. Rome, aye; Mr. Waldman, aye; and Mr. Saunders, aye. Letter to the
Town Commission is attached.
Mr. Saunders noted that each of the Planning Commission members had
received a memo from Town Manager Elaine Roberts, with a list of 3
items to be answered concerning Boca Hi. Mr. Blosser stated that the
time element really prohibits a full and extensive and explicit reply
to this request; and, under the circumstances, the Planning Commission,
in his opinion, should withhold replying, at this time.
Mr. Waldman noted that in 1976, Thomas Becker, Town Attorney, wrote a
letter to Boca Hi advising them of the invalidation of the RPUD and
that they had not complied with the Ordinance, therefore, in his opi-
nion, they were not operating further under the RPUD. Mr. Blosser noted
that, after that statement was made by Attorney Becker back in 1976, the
Town Commission allowed a number of things to proceed, including Dalton

Place and Aberdeen Arms and the assumption had to be that whatever the
situation then, the Town Commission had subsequently countenanced the
PUD as continuing in that form.
Mr. Saunders advised members of the Planning Commission that he would
like to note why no answers or no rebuttal is being transmitted in
answer to the August 8, 1984, request of Town Manager Elaine Roberts.
Mr. Saunders noted he had "received a civil action summons this day,
namely a civil action suit against the Town of Highland Beach and the
Chairman of the Planning Commission on the Boca Hi issue. He said,
as a result of this legal action against the entire Planning Commis-
sion, he felt it best to withhold any reply by the Planning Commission
to the Town Commission.
Mrs. Rome noted that at this time she did not feel that members should
put in writing any of the things that would (a) possibly place members
in jeopardy, (b) possibly place the Town in jeopardy.
Following the discussion, Mr. Blosser offered the following MOTION, to
be transmitted promptly to the Town Commission "for its, meeting time
• this afternoon". "We respectfully decline to reply, at this time, to
your letter of August 8, 1984, on the grounds that any response will
be untimely and unproductive". Mrs. Rome seconded the MOTION. Mr.
Blosser voted aye; Mr. Ward, aye; Mrs. Rome, aye; Mr. Waldman, aye;
and Mr. Saunders, aye.
ADJOURNMENT
Mr. Saunders advised the next regular meeting of the Planning Commission
is scheduled for Wednesday, September 12, 1984, at 9:30 a.m. The agenda
closes on Wednesday, August 29, 1984.
Mrs. Rome moved to adjourn the meeting; Mr. Blosser seconded the MOTION.
Mr. Blosser voted aye; Mr. Ward, aye; Mr. Waldman, , Mrs. Rome, aye;
