OF THE ADOPTION OF A BUILDING MORATORIUM ORDINANCE REGARDING
THE GRANTING OF BUILDING PERMITS AND CONSIDERING THE ADOPTION
• OF AN ORDINANCE PROVIDING FOR A LIMITATION OF ONE YEAR ON THE
EFFECTIVENESS OF ANY APPROVED SITE PLANS FOR CONSTRUCTION IN
THE TOWN OF HIGHLAND BEACH, FLORIDA.
Acting Chairman Dr. G. P. Weiss, called the Public Hearing to order at
10:00 a.m., advising this is a public hearing with due public notice called
by the Planning Commission/Local Planning Agency, Town of Highland Beach,
Florida, for the purpose of consideration of the adoption of a building
moratorium ordinance and also for the consideration of the limitation of
a one year effectiveness for site plan reviews. The recording secretary
called the roll. The agenda is attached.
Present: Dr. G. C. Linn, C. Nastri, E. L. Snyder, I. S.
Saunders, Dr. G. P. Weiss and W. J. Wernecke.
Town Manager E. W. Roberts gave a brief resume of the procedures required
for approval of a moratorium ordinance. Dr. Weiss called upon members of
the audience to voice any comments or opinions at this time. Dr.Richard
Orman, representing Mr. C. D. Milani, advised that Mr. Milani was request-
ing "no moratorium be put in place," and asked that property owned by Mr.
Milani be exempted in the adoption in in this new moratorium.
•Town Attorney T. E. Sliney noted this public hearing is held to obtain com-
ments and opinions from the public and no decision will be made at this
time. Acting Chairman Dr. Weiss read the public notice, copy attached. Town
Attorney T. E. Sliney advised the Commission members that they are to review
any proposals, then make a recommendation to the Town Commission, Attorney
Sliney read the ordinance relating to Site Plan reviews and approvals and
including time limitations. Copy attached.
Acting Chairman Weiss spoke concerning the Planning Commission's re-
sponsibility and the fact that decisions do not rest with the Planning
Commission, the Town Commission having the final say. Commission members
agreed with the opinion of Dr. Weiss.
Mr. Wernecke spoke with reference to a letter written by Dr. Weiss to Mayor
Louis Y. Horton, dated June 16, 1982, in reply to letter written by Mayor
Horton, dated June 4, 1982, relative to density bonuses and, in addition,
to zoning in progress.
Following a general discussion, Mr. Saunders moved to recommend approval
by the Town Commission, for a limitation of one year, with a one time
extension of ninety (90) days, for due cause, seconded by Mr. Snyder. Mr.
Wernecke voted aye, Mr. Nastri, aye, Mr. Snyder, aye, Mr. Saunders, aye,
Dr. Weiss, aye. Copy of letter of transmission, dated August 2, 1982, ad-

Acting Chairman Dr. Gilbert P. Weiss called the Regular Meeting to order

at 12:25 P.M., advising this is a Regular Meeting of the Planning Commission/
Local Planning Agency, Town of Highland Beach, Florida. The recording
secretary called the roll. The agenda is attached.
Present: W. J. Wernecke, C. Nastri, E. L. Snyder, I. S.
Saunders, Dr. G. P. Weiss, Dr. G. C. Linn (Alt.)
MINUTES
Dr. Weiss noted the first order of business would be examination of minutes
of the meetings held June 9, 1982, June 23, 1982 and July 8, 1982. The
minutes having been previously examined, Mr. Snyder moved to approve the
minutes as presented, Mr. Nastri seconded the motion. Mr. Wernecke, voted
aye, Mr. Nastri, aye, Mr. Snyder, aye, Mr. Saunders, aye and Dr. Weiss, aye.
Acting Chairman Weiss advised the next order of business to be Election of
Officers for the 1982/1983 term. Mr. Snyder nominated Dr. Weiss for Chair-
man, Mr. Wernecke seconded. Mr. Wernecke voted aye, Mr. Nastri, aye, Mr.
Snyder, aye, Mr. Saunders, aye, Dr. Weiss, aye.
Mr. Saunders nominated Mr. Snyder for Vice Chairman, Chairman Weiss seconded,
•Mr. Wernecke voted aye, Mr. Nastri, aye, Mr. Snyder, aye, Mr. Saunders, aye,
and Chairman Weiss, aye.
Mr. Snyder nominated Mr. Wernecke for Secretary, Chairman Weiss seconded.
Mr. Nastri voted aye, Mr. Snyder, aye, Mr. Saunders, aye, Chairman Weiss,
aye, Mr. Wernecke, aye.
Building Official Fran Hamzik addressed the Planning Commission advising
members that the Coronado project needs state approval and approval by the
Planning Commission, for the proposed dolphins on the Intracoastal border
of the project site. Following discussion it was determined that the Plann-
ing Commission will hold public hearings if required by the State of Florida.
Town Manager E. W. Roberts advised that spas should be included in the
Zoning Ordinance since a spa is considered a structure.
ADJOURNMENT
Chairman Weiss advised the next regular meeting of the Planning Com-
mission will be held on Wednesday, August 11, 1982, at 9:30 a.m. At
that time, Mr. Lee Henderson, representing Gee & Jenson, Architects -

MORATORIUM
Following a discussion of the proposal to adopt a recommendation to the
Town Commission indicating that the matter of the Moratorium was discussed
and placed for a vote, The motion was made and due to the lack of a second,
a vote was not taken. The Moratorium issue was not resolved at this time.
The Planning Commission voted and agreed in concept to a one year limit on
Site Plan Approvals with a one time ninety (90) day extension to be granted.
Town Attorney T. E. Sliney is currently reviewing several questions re-
garding this matter. Copy of memorandum dated August 2, 1982, is attached.
ADJOURNMENT
Acting Chairman Dr. G. P. Weiss advised the Public Hearing was adjourned
at 12:15 p.m.
A regular meeting of the Planning Commission/Local Planning Agency, Town
of Highland Beach, Florida, will be held immediately following this Public
