NEW SEC. 13.33 TIME-SHARE ESTATE, TIME-SHARE UNIT. PUBLIC HEARING. • '�� 30PM Chairman Boscove called the meeting to order advising this was a public hearing called to discuss two Zoning changes to the Town Zoning Ordinance. At a workshop meeting held June 4, 1980, Sec. 5.1 and 5.2 were examined and discussed (Fences, walls and hedges.) Present: J.A.Boscove,N.M.Johnson,J.M.Farrin,R.B.Myers,W.Bonny,J.J.Basso. Chairman Boscove noted the sentence in paragraph (a) that excludes height restrictions along AIA, and noted the proposal is to eliminate the second half of the sentence. Mr. Johnson read the section of sentence to be deleted, as follows: "except that such limitations shall not apply in required yards adjacent to SR AlA (South Ocean Boulevard) other than as ne- cessary to provide visibility triangles as set forth above." Mr. Myers moved to approve the recommendation for zoning change as read, second by Mr. Johnson. Mr. Bonny, Mr Johnson, Mr. Myers and Chairman Boscove voted aye for approval. This recommendation applies to each District. Chairman Boscove advised that the second item to be discussed would be an addition to the existing Zoning Ordinance, referencing Time -Sharing Estates. The recommended addition for Section 3.2 is as follows: • 3.2 In all Zoning districts within the Town of Highland Beach "Time -Share Estates" and "Time -Share Units" as defined in Section 13, "Definitions", are prohibited. The recommended addition in Section 13 "Definitions" is as follows: 13.33 a. Time -Share Estate. Time -Share Estate means any interest in a unit under which the exclusive right of use, possession, or occupancy of the unit circulates among the various owners of Time -Share Estates in such unit in accordance with a fixed time schedule on a periodically recurring basis for a period of time established by such schedule. b. Time -Share Unit. Time -Share Unit means a unit in which Time -Share Estates have been created. Mr. Johnson moved to approve recommendation that this change be made in the Zoning Ordinance. Mr. Myers seconded. Mr. Johnson, Mr. Myers, Mr. Bonny, Adm. Farrin and Chairman Boscove voted aye. This recommendation will be submitted to the Town Commission for examination.
