Chairman Boscove called the meeting to order/ advising this was a Public
Hearing called by the Planning Commission for the purpose of discussing
a proposed amendment to the present Zoning Code, Ch. 30, Section 5.3(d),
"Noncommercial docks, piers, launching facilities and mooring devices."
The Agenda is Attachment "A". The recording secretary called the roll.
Present: L. 0. Edlund, N. M. Johnson, J. A. Boscove, J. M.
Farrin, R. B. Myers, W. Bonny (Alt.) and J. J.
Basso (Alt.)
At the meeting held on February 13, 1980, members of the Planning Com-
mission agreed to hold a public hearing to review the proposed amendment,
prior to referral to the Town Commission for action.
Chairman Boscove noted there is a restriction of twenty-five (25) feet
to the adjoining property lines for docks under the present code. The
recording secretary read the proposed revision to Sec. 5.3(d), Attach-
ment "B". Following the reading a general discussion included reference
to the possibility of using davits; the need for sufficient dock space
to allow for motion caused by wake action, wind and tides, and setbacks
• for corner lots.
Following the discussion Chairman Boscove noted that final action on the
proposed amendment is taken by the Town Commission. Chairman Boscove ad-
vised that the recommended setback change from twenty-five (25) feet to
fifteen (15) feet applies only to areas outside of the RS District.
Copies of pictures illustrating boats docked at corner lots were made
available for examination at this meeting.
The recording secretary read a letter from Mrs. Catherine P. Anthony of
4229 Intracoastal Drive, Bel Lido, Attachment "C". Chairman Boscove called
upon members of the Planning Commission for comments.
Motion was made by Chairman Boscove to recommend that the following be
added to Sec. 5.3(d) of Ch. 30, Zoning Code, Town of Highland Beach,
Florida, "Noncommercial docks, piers, launching facilities and mooring
devices:
The Town Commission as a special exception, may permit deviation of the
side setback requirement to adjoining residential property from twenty-
five (25) feet to fifteen (15) feet provided the following requirements
• are met:
1. All districts except RS
No requirements

2. RS Districts
Lots with a rear lot line (water side) between
fifty (50) and seventy (70) feet measured in a
continuous straight line.
A request for a variance may be considered by the Board of Adjustment, to
install lifting devices on the following lots in the Bel Lido subdivision:
Lot #4, Block 5; Lot #4, Block 3; Lot #32, Block 4 and Lot #1, Block 4.
The dimensions to the adjoining property lines to be determined by the
Board of Adjustment at the time of the Public Hearing.
Mr. Johnson seconded. Mr. Edlund voted aye, Mr. Johnson, aye, Adm. Farrin,
nay, Mr. Myers, aye, Chairman Boscove aye. A letter recommending this
amendment will be transmitted to the Town Commission for further action.
ADJOURNMENT
Chairman Boscove advised the Public Hearing was adjourned at 9:30 p.m.
•The next regular meeting of the Planning Commission is scheduled for
Wednesday, May 14, 1980, at 7:30 p.m.
