1979.09.12_PB_Minutes_RegularMINUTES: PLANNING COMMISSION/LOCAL PLANNING AGENCY, TOWN OF HIGHLAND BEACH, FLORIDA. REGULAR MEETING. SEPTEMBER 12, 1979 PROPOSED ZONING CHANGES. IS Vice Chairman Johnson called the meeting to order at 7:35 p.m., in the absence of Chairman Boscove, advising this was a regular meeting of the Planning Commission. The Agenda is Attachment "A". The recording secretary called the roll. Present: N. M. Johnson, C. B. Blankenship, R. B. Myers, J. M. Farrin. Absent: J. A. Boscove, L. O. Edlund, W. Bonny. MINUTES Vice Chairman Johnson noted the first order of business to be approval of the minutes of the meeting of August 8, 1979. Mr. Blankenship moved to accept the minutes as presented, Mr. Myers seconded. Mr. Johnson, Mr. Myers, Mr. Blankenship voted aye for approval. Vice Chairman Johnson called upon Mr. Roy Flack, in audience to present question on Section 5.16(b)(4) Hurricane and Flood Damage Protection, as it applies to Lot #13 East and West, site of the "Parker Highland" develop- ment. Mrs. E. W. Roberts, in audience recommended the Parker Highland site plan be returned for examination by the Planning Commission subject to a change of the Zoning Ordinance. in Mr. Flack noted Section 7-2.1 of the Code of Ordinances, Ordinance #179, "Height of ground floor area" (Attachment "B"). At the conclusion of the discussion, members of the Planning Commission requested Town Manager E. W. Roberts to consult Town Attorney Thomas E. Sliney for an opinion on the question. Adm. Farrin then moved to approve the recommendation for change in Chapter 30, Zoning, of the Code of Ordinances, Section 5.16(b)(4) add "in RS District (single family) and in RML-1 District (residential multiple family - low density). " and to recommend that in Chapter 7, Ordinance ##179 of the Code of Ordinances, Sec. 7-2.1,Buildings, be amended to include the following: "and shall not exceed eight (8) feet above m.s.l. in RS and RML Districts." Mr. Blankenship seconded the motion, Mr. Johnson, Mr. Myers, Mr. Blankenship and Adm. Farrin voted aye. The following additional recommendations were made for referral to the Town Commission at a later date: 4.1 (e) (9) Add '.'limited to two (2) habitable floors", in RS district. Motion by Mr. Blankenship second, Adm. Farrin, all aye votes. • 4.2(e)(10) (RML-1) following "perimeter", add "limited to two (2) habitable floors." REGULAR MEETING SEPTEMBER 12, 1979 PROPOSED ZONING CHANGES. 4.3(e)(10) Following "above" add "if the structure is one (1) or two (2) stories, then the stories are limited to a maximum of thirty-five (35) feet. This thirty-five (35) feet is measured from the mean finished grade at the building perimeter. Motion by Mr. Myers, second, Mr. Blankenship, all aye votes. 4.3(e)(16) Include all of paragraph 4.4(e)(16). Note deletion of last line "All other requirements must be met." Motion by Adm. Farrin, second, Mr. Blankenship, all aye votes. 4.3(e)(10) RML-2 In connection with parking structure tied to RMM and RMH main structure it was recommended that this section be revised to read "Attached at a minimum of 25% to the main structure and at least 75% of the required parking underneath, as part of the structure." Motion by Mr. Blankenship, second, Mr. Myers, all aye votes. 4.4(e)(16) RMM Delete "All other requirements must be met." 4.3(e)(16) RML-2 Include this paragraph in RML-2 and RMH 4.5(e)(16) RMH DISTRICTS - "Lots in this district whose width exceed their depth are of an unusual configuration. The Planning Commission shall work with the builder in determining the placement of a builder or buildings on the lot(s) to in- sure the best possible use of the property. The Town Commission, as a special exception may permit deviation from the width and length requirements (11) and (12) above." Motion by Mr. Myers, second, Adm. Farrin, all aye votes. 5.3(c) Delete "pool", preceding "decks", lines 1, 4, 5. Motion by Mr. Blankenship, second Adm. PROPOSED ZONING CHANGES. • At the conclusion of the review of recommended changes, Vice Chairman Johnson indicated a workshop meeting would be in order to further examine all changes being considered. A workshop meeting will be held on Wednesday September 19, 1979, at 7:30 P.M. for examination of proposed zoning changes only. A tentative date for a Public Hearing of recommended zoning changes was set for Wednesday, October 10, 1979.
