REVIEW OF SECTION 4.2 AND SECTION 5.9 OF CHAPTER 30, ZONING, OF THE CODE OF ORDINANCES, ORD. #336. Chairman Boscove called the meeting to order at 7:30 p.m., advising this was a Workshop meeting of the Planning Commission/Local Planning Agency called for a review of Section 4.2 and Section 5.9 of the Zoning Code Ord. #336, Town of Highland Beach. The recording secretary called the roll, the Agenda is Attachment "A". Present: J. A. Boscove, N. M. Johnson, R. B. Myers, J. M. Farrin, L. O. Edlund. Absent: C. B. Blankenship, W. Bonny Chairman Boscove noted there were two subjects to be considered, one the comparison of the figures of the approved RPUD for Boca Hi and the other the proposed zoning changes. Mr. Paul Twitty presented Building Dimension Sheets showing Plan "A" Modified (approved under Ord.# 228, April 1974), Plan "A" Modification II (Approved Braemar Isle) and Plan "A" Modification III (Proposed Sites B & C) Attachment "B". Mr. Twitty noted comparison of the three plans and the variances therein. •In defining "open space", Mr. Twitty advised this was the marina, the landscaped open space, the area not covered by the towers and also - according to the original RPUD - included the parking garage area used for recreation space. The discussion following included reference to that open space atop the parking garages which is used for recreational purposes. Mr. Twitty noted the tower buildings and the townhouses were approximately 20 feet from the seawall, the garage approximately 16/17 feet from the seawall. Mr. Delaney advised there were 8 apartments per floor and the tower buildings were to be 16 story structures. Adm. Farrin suggested Town Attorney T. E. Sliney be consulted in the matter of referring Plan "A" Modified III, proposed sites "B" and "C" to the Town Commission. It was agreed, by a straw vote of four to one, that the proposed changes were not significant or out of context and could be approved by the Planning Commission. Mr. Delaney expressed the hope that the Planning Commission would take the authority already granted to them and approve the formal presentation of the proposed Modification III when the presentation is made at a future meeting. Members agreed to hold a Special Meeting, at 7:00 p.m., on Wednesday, May 9, 1979, to continue the examination of the proposed revision of the Boca Highland Project Plan "A" Modification III, Buildings "B", "C" and Townhouses. REVIEW OF SECTION 4.2 AND SECTION 5.9 OF CHAPTER 30, ZONING, OF THE • CODE OF ORDINANCES ORD. ##336_ At the conclusion of the Boca Highland review, Chairman Boscove advised the next item on the agenda to be examination of the Zoning Ordinance, particularly Sec. 4.2 (e), Ch. 30, RML-1 District, which reads (Setbacks) (3) Front Yard: One story ; 25 feet Two story; 25 feet From AlA; 40 feet structure It implies thatthe As no more than two stories but does not specify. Reference was made to a structure under construction being advertised as having "three floors", when in fact the structure has two floors with a mezzanine. Chairman Boscove referred to a memo from Town Manager E. W. lbberts, dated April 4, 1979, Attachment "B". It was agreed that a recommendation be made to change Ch. 30, Sec. 4.2 (e) (1) to read as follows: (10) Maximum building height. Thirty five (35) feet above mean finished grade • at the building perimeter; limited to two (2) habitable floors. Mr. Earl Totz in audience, voiced objection to the structure previously referred to. Chairman Boscove read from Zoning Ordinance #k253, Ch. 30, Sec. 5.5 (b) Height Regulation, attachment "C". The following changes in Zoning Ordinance #p336, Ch. 30, were recommended: RS. Sec. 4.1 (e) (9) Maximum building height. Thirty-five (35) feet above mean finished grade at building perimeter, limited to two (2) habitable floors. RS Sec. 4.1 (e) (11) Parking. Two (2) parking spaces for each dwelling unit; parking can be included as part of the first floor area. RML-1 Maximum building height. Thirty-five (35) Sec. 4.2 (e) (10) feet above mean finished grade at the building perimeter, limited to two (2) habitable floors. R1-4L-2 line 7, after 'above' insert "if the structure • Sec. 4.3 (e) (10) is one (1) or two (2) stories then the stories are limited to the maximum height of thirty- five (35) feet above mean finished grade at the building perimeter;" This insert to be included in RML-1, RML-2, RMM and RMH. RML-2• Line 5, after 13); insert "parking can be Sec. 4.3 (e) (12) included as part of the first floor area"; Chairman Boscove noted Sec. 5.9(a) Off-street parking and loading; last sentence "In RS and RML district parking is limited to front and/or side yard and only on paved surfaces;" and advised that he had a copy of a letter dated February 1, 1979, from Mr. M. H. Dent to Mr. Harry Bauer in which Mr. Dent suggests driveways and parking areas be limited to not more that 8/ of the area of the lot and located only in front yards or where the entrance of the garage is on the side of the house. Attachment "C". Chairman Boscove noted that the paved area could be limited to the minimum parking area and the ingress and egress areas. It was agreed the following might be inserted in paragraph 2 of Sec. 5.9 (a) after the word "another", "Paved surfaces are limited to the required off-street parking area as required above". Sec. 5.12 (c) and (d) were examined and will be reviewed at a later date. At the conclusion of the examination of the Zoning Code it was agreed the • recommendations would be considered and examined at the next meeting. ADJOURNMENT Mr. Johnson moved to adjourn the meeting, Mr. Myers seconded. The following meetings are scheduled for the month of May, 1979: May 9, 1979 7:00 P.M. SPECIAL MEETING.
