URBANEK PROPOSAL, JULY 20, 1978.
Chairman Boscove called the meeting to order at 7:30 p.m., advising this
was a special meeting called for the purpose of discussing the proposal
submitted by Mr. Earl Totz, Agent for Mr. August Urbanek, relative to the
properties involved in the court decision of December 1973. The Agenda
is Attachment "A", the recording secretary called the roll.
Present: J. A. Boscove, N. M. Johnson, R. B. Myers, Adele
Allen, J. M. Farrin, C. B. Blankenship (Alternate).
Absent: 0. L. Edlund (Alternate)
Mr. Boscove noted that the Town of Highland Beach and Mr. August Urbanek
are involved in litigation concerning densities. The Town Commission had
requested that the Planning Commission examine the proposal and determine
if a recommendation for approval or denial of the proposed compromise should
be referred to the Town Commission. Chairman Boscove called on Mayor
Horton, in audience, for comments. Mayor Horton reviewed the events and
actions leading to the court action and the possible decisions resulting
from the litigation.
An in depth discussion of the building sites involved, followed Mayor
Horton's comments. Chairman Boscove noted the receipt of the letter dated
July 18, 1978, addressed to the Hon. Louis Y. Horton and all Commissioners,
•previously read by members of the Planning Commission and read into the
record of the Special Town Commission meeting held on July 18, 1978, (At-
tachment "B"). The discussion following covered each site noted in Mr.
Totz' letter.
It was noted that the original court order as it applied to Site 6, Town
Lot #109, applied only to the East Side. In the discussion of the figures
used in calculations made by Mr. N. M. Johnson, he noted that this inform-
ation was obtained from the Palm Beach County Assessor's Records. In-
formation provided by Mr. Earl Totz was obtained from surveys on file at
the Highland Beach Town Hall. At the conclusion of the discussion relative
to the use of the figures, it was agreed that only those figures presented
by Mr. Earl Totz in his letter of July 18, 1978, would be considered in
the examination of the proposal.
The members of the Commission continued with the review of present densities,
as compared with proposed densities, for -
Site 7 Lot 116/117 East and West
Site 4B Lots 95, 96, 97 West
Site 4A Lot 96 East Recreation Bldg.
Site 4BB Lot 93, 94 West
At the conclusion of the examination of zoning densities prior to adoption
of Ordinance #336, (as compared with current densities), Chairman Boscove
called on Mr. Totz for additional comments. In addressing the members of

the Commission, Mr. Totz noted that site 4BB was not involved in the court
action; that the architectural design of the proposed buildings would be
40aesthetically change, and noted there would be some one -bedroom apartments
in some buildings. He added that he had proposed in his offer to the Town
to combine Site 4B, 4BB (Morrison tract 4.56 acres), and 4A on the ocean, as
a unity of title. Mr. Totz provided a signed copy of his comments for the
recording secretary (Attachment"C"), copies of this document will be distrib-
uted to members of the Planning Commission.
Col. H. A. Hauck, in audience, spoke regarding road conditions as related to
additional traffic, increased demands for water and sewer facilities and the
fact that the proposal was being considered at a time when a great many
residents were out of Town.
Chairman Boscove addressed the members of the Planning Commission, advising
that the Town Commission had referred the matter of the proposal presented
by Mr. Totz for Mr. Urbanek, to the Planning Commission for examination and
an opinion as to whether to accept or deny this compromise proposal. The
members were requested to express their individual opinions regarding the
proposal. Following lengthy discussion of the proposal as presented, Mr.
Johnson offered the motion "That Mr. Urbanek's proposal dated July 18, 1978,
as presented through his Agent, Mr. Earl Totz, is completely unacceptable to
the Town." Mr. Myers seconded the motion.
After additional discussion, Mr. Johnson amended his original motion as follows:
What Mr. Urbanek's proposal dated July 18, 1978, as -presented through his
Agent, Mr. Earl Totz, is completely unacceptable to the Town. It is the
feeling of the Planning Commission that the Town may negotiate with Mr.
Urbanek to secure substantial reductions in densities from those proposed in
his letter dated July 18, 1978, and delete the stipulations of paragraph 4,
5, and 6. Seconded by Mr. R. B. Myers, the vote was as follows: (At 9:40 p.m.,
Mrs. Allen asked to be excused. Mr.Blankenship,Alternate, replaced Mrs. Allen.)

The motion as amended and offered by Mr.Johnson,was approved. This information
will be transmitted to the Mayor and Members of the Town Commission to expedite
