RI CHARD ORMAN-ZONING,!OCT OBER 17, 1977. t •Chairman Boscove called the meeting to order at 7:02 p.m. advising this was a Workshop and Inventory meeting with Dr. Richard Orman to examine the Zoning Code. The recording secretary called the roll. The Agenda is Attachment "A". Present: J. A. Boscove, N. M. Johnson, R. B. Myers, J. M. Farrin, H. C. Storm. Absent: A. Allen, 0. Edlund. Dr. Orman examined the draft of Sec. 3, Page 30-7, "CONDITIONAL USE", superseding "SPECIAL EXCEPTIONS'. Following a discussion of this Section, Section 2, 2.6 and Section 2.7, Page 30-4 was noted. It was agreed these paragraphs would be deleted as recommended. Following the discussion of "PERMITTED ACCESSORY USES AND STRUCTURES', the need for additional Section identification numbers was noted. Dr. Orman advised "ACCESSSORY USE" as used in 'this Section referred to Park- ing Lots. The discussion included reference to free standing garages on Town lots. Sec. 5.3 "Accessory Uses and Structuresm was examined . Changes as noted in Minutes of October 5, 1977 The following recommendations were made after examination of Sections: • Page 30-17 Sec. 5.7 Insert period after 'ground' Page 30-65 Sec. 7.3 delete "wherever practic- able" Page 30-66 Sec. 7.3 (d) Delete 'of replacement value' insert, 'of appraised value' Page 30-66 Sec. 7.4 (b) Delete 'of its replacement cost' insert, 'of appraised value' Page 30-67 Sec. 7.5 After 'structures; delete from "with",through ($3,000.00) Page 30-68 Sec. 7.5. (f) Delete 'of replacement cost' insert of appraised value' Page 30-68 Sec. 7.7. (b) Delete 'of replacement cost insert 'of its appraised value' Page 30-66 Sec. 7.4 Delete 'of its replacement value' insert 'of its app- raised value' Page -2- MINUTES: LOCAL LAND PLANNING AGENCY/PLANNING COMMISSION -WORKSHOP -DR. RICHARD ORMAN - ZONING, OCTOBER 17, 1977. •Dr. Orman noted the difference between appraised value and assessed value and recommended the use of the term "appraised value". Following examin- ation of Sections 7.3. and 7.4., it was determined that "replacement value" be deleted where used in these two Sections and "appraised value" be in- serted. In Section 7.3. (e), Page 30-66, "such nonconforming use shall be dis- continued within three years" --- the issue of three years was discussed. Section 5.3. (d), Page 30-12, relating to docks, piers, ramps and launching devices, was reviewed. It was recommended that the section remain as is, with the addition of reference to the requirements set forth by the Army Corps of Engineers, which must be met prior to receiving permission for building from the Town of Highland Beach. The sections covering Height Regulations, Essential Services, Temporary Structures and Parking were reviewed. These areas to be presented to the joint meeting of Town Commission and Planning Commission at a later date for examination. At the conclusion of the discussions, Dr. Orman noted that a tentative date for discussion of the Zoning Ordinance was scheduled for 9:30 a.m., Thurs- • day, October 27, 1977, at a Town Commission Workshop Meeting. The next scheduled Planning Commission meeting will be held on Monday, November 14, 1977, at 7:00 p.m. This meeting tentatively scheduled to be a Joint Workshop Meeting with the Town Commission, Dr. Orman and the Planning Commission.
