Chairman Boscove called the meeting to order at 10:20 A.M., advising this was a continuation of the Workshop Meeting of March 11, 1975. The purpose of the meeting, to continue a discussion of the review of the Comprehen- sive Plan. Present J. A. Boscove, N. M. Johnson, R. B. Myers, A. Allen (Alternate) . Absent E. A. Potere, J. Schober (Alternate), J.M.Farrin. Also present, in audience, were Col. Fran Johnson, Mayor Gilday, Town Manager E. W. Roberts and Mr. Jim Smoot. Mr. Smoot provided a color coded map of the Town of Highland Beach which he described as follows - COLORS Tan Uncommitted, no plans submitted Red Uncommitted, 300 unit potential on property -Motel Bright green F.I.N.D., T.I.I.F., and Town Blue Church Stippled areas Interim sewage treatment plant Yellow Single Family Light green Vacant tract Brown Multiple Family The following statistical information was included in Mr. Smoot's dis- cussion - Acreage Totals 281.5 % F.I.N.D., T.I.I.F., Church 17.84 6.33 Single Family 52.33 18.59 Multiple Family 211.33 75.07 Dwelling Units 6,238 % Single Family 140 2.24 Multiple Family 6,039 96.80 Conversions - 59 .96 @ 20 U/A In further discussion, Mr. Smoot advised there was a maximum future po- tential density figure of 6,238 total units in the community to be de- veloped on a lot by lot and RPUD basis, There are at present 64 private, single family dwellings; 6,039 multiple family dwellings and 59 committed at 20 units per acre. The existing motels are at a close to maximum density. A discussion followed, with Col. Fran Johnson inquiring as to the property next to the Ridge Apartments (Lots #94, 95 and 96). This area zoned RM 20 (20 units per acre). Mr. Boscove advised a revision of the zoning might result in a possible difference of only 16 units (instead of 20). Mr. Smoot discussed the traffic code and its vagaries, stating a Palm Beach County law requires an impact analysis outlining traffic patterns and number of vehicular trips daily on County roads. He noted that this law was passed approximately two years ago and has not been tested. In reply to Chairman Boscove's question, Mr. Smoot commented this juris- diction has no effect on State roads, adding, in connection with the possibility of widening State Road A-1-A, approval would be necessary from the County. A discussion of the value of a "bulge" in SR A-1-A to facilitate left hand turns in certain areas followed. Col. Fran Johnson voiced the opinion that the traffic volume might double within a year. Mr. Boscove added the Town was not in favor of widening State road A-1-A to a four lane road. Chairman Boscove questioned the resulting effects of elimination of land due to erosion. Mr. Smoot noted that the loss of such land was the owner's loss. The new high water line would serve as determining factor. In reply to Chairman Boscove's inquiry as to an interpretation of the wording "valid reason", with relation to proposed zoning changes, Mr. • Smoot commented the courts have held zoning changes may be made in like categories,i.e., commercial properties from heavy commercial to lightest type but zoning may not be changed to a different classification, such as residential from commercial. Col. Fran Johnson commented on the swing toward a sympathetic attitude on the part of Judges toward communities. Mr. Smoot stated (in reply to a question by Chairman Boscove) on the basis of the size of that area shown in tan on the map displayed, only one parcel could be changed. Mr. Smoot then offered as a guideline a check of the distribution of properties and consideration of the valid reasons for zoning changes. If property owners of 10 to 20•% of the ex- isting units seek revision of the Comprehensive Plan, investigation of the possibility of community improvement resulting from suggested changes should be instigated. Mrs. Roberts noted that completion of the new bicycle path will provide a link with commercial facilities located outside of the perimeter of Highland Beach. Mr. Meyers inquired as to whether the Highland Beach density was higher than that of Boca Raton and/or Delray Beach. Mr. Smoot was of the opinion that Highland Beach was greater. He added that averaging densities in many instances provides a good concept, citing the area encompassing the Boca Raton Spanish River Park and the condominiums • located in that same area. In reply to Chairman Boscove's question regarding an update on requirements for sewer, water and other facilities, Mr. Smoot recommended a delay in any action at this time. Mrs. Roberts inquired as to whether the Town of High- land Beach might require a developer to provide facilities for run-off. Mr. Smoot informed the Commission he would obtain information on Federal regulations related to this issue and forward to the Town of Highland Beach. Replying to Mr. Boscove's inquiry, Mr. Smoot defined a sub -division as any parcel of property divided into three or more pieces, provided they are less than five acres. Mr. N. M. Johnson commented on three factors to be considered in densities; traffic, storm water discharge and fresh water. Flood insurance was discussed with Mr. Smoot advising a claimant may not recover for damages in some instances if all doors, windows, etc., are not completely watertight, including those portions situated below ground. Further discussion of flood insurance ensued. The matter of determining a mean high water line on the Intracoastal • (west) side of SR A-1-A was discussed. Chairman Boscove indicated the need for a distinct delineation on the zoning map for the Intracoastal waterway mean high water line. 11 Mrs. Roberts advised that copies of the December 24, 1969 map of the Town of Highland Beach, will be made ready for reference by the Planning Commission. Chairman Boscove asked for further discussion or questions, there were none. Mr. N. M. Johnson offered the motion to adjourn, Mr. Myers seconded. The Workshop meeting was adjourned at 12:05 P.W.., E.
