MINUTES: PLANNING COMMISSION - REGULAR MEETING - JANUARY 14, 1975.
Chairman Boscove called the meeting to order at 7:35 P.M. The Agenda is

J. M. Farrin and R. B. Myers.
MINUTES
Advising this was a regular meeting of the Planning Commission, Chairman
Boscove indicated the first order of business to be consideration and
motion for approval of minutes of December 11, 1974, (Public Hearing -
Leadership T. V. and Regular Meeting). Copies of minutes having been
examined, reading thereof was waived; on motion made by Mr. Potere
and seconded by Mr. Johnson these minutes were unanimously approved.
COMMITTEE REPORTS
Admiral Farrin reported on contacts with the Florida Inland Navigation
District (Attachment "B") relative to seawalls and bulkheads. Mrs.
Roberts suggested files be set up for the Planning Commission Committees.
It was the consensus that these files be maintained in the Building
Department.

BOCA HI
Chairman Boscove discussed the field trip taken with Mr. Thomas Delaney
at Boca Hi. A discussion of the Florida State rulings on setbacks
followed, with Mr. Sliney*in audience, and members of the Commission.
Mr. Sliney advised the petitioner must obtain a waiver for a variance
from the 50 ft. setback as set by the state. This waiver to be ob-
tained from the State Department of Natural Resources.
A letter is to be written to Mr. Delaney requesting Boca Hi, Inc. to
obtain a ruling on the State setback as it applies to Boca Hi property
and present this information in approximately one month to the Planning
Commission for further action on the consideration of application for
a 50 ft. setback.
Mr. O'Grady questioned the approval of the RPUD. A discussion of the
effect on original approval of RPUD #2 (Boca Hi) followed. Mr. Losee
in audience noted the amendment in Ordinance #264 ordaining construction
of not less than 25/ of this RPUD development must commence no later
than six months from the date of adoption of Ordinance #264 (January 7,
1975). Mrs. Stewart in audience, and Mr. Johnson discussed the pos-
sibility of the RPUD approval having been voided by the petitioners
change in plans. Town Counsel advised the term void was incorrect
• and the original concept of RPUD still stands. Mrs. Stewart also
noted that landscaping plans had not been submitted by Boca Hi. The

• discussion included the question of approval of the proposed parking
structure on the West Side ?'of A-1-A, with Mr. Myers noting that this
approval is ancillary to procuring approval for east side petition.
Col. Hauck in audience questioned the time limit allotted the petitioner
after permit is granted and before construction is started. A discussion
of this limitation and requests for extensions ensued.
Mrs. Roberts read a letter from Scott Dickenson (Attachment "C") con-
cerning this issue. Mr. O'Grady advised the Boca Hi application was
dated May 28, 1974, and no request for an extension has been made.
MISCELLANEOUS
Mrs. Elaine Roberts, Town Manager, advised that Mr. Jim Smoot has
suggested consideration be given to the building of a boardwalk from
Bel Lido north through Highland Beach on the east side of the Intra-
coastal Waterway as a Public Walkway. Mrs. Roberts will arrange a
meeting with Mr. Smoot to discuss the matter with the Planning Com-
mission.
Following a discussion, instituted by Col. Hauck relative to the
• possibility of Adm. Farrin's resignation (to avoid a conflict of
interest in connection with Aberdeen Arms litigation) Chairman
Boscove advised that in the event of a possible conflict of interest,
Adm. Farrin could abstain from voting.
Chairman Boscove presented the question of the consideration of revising
the Zoning Ordinance to amend the height limits for structures and
auxiliary buildings inside building lines. A public hearing will be
called and recommendations made at a later date.
Mrs. Stewart submitted a copy of a Boca -Hi survey to Chairman Boscove,
dated 5/30/73, for examination.
An artists conception of a change in Zoning, north of Penthouse High-
lands, Lots 106 to 111 inclusive, was distributed to the members of
the Planning Commission by Mrs. Roberts (Attachment "D").
A Workshop Meeting to consider changes in the Comprehensive Plan was
recommended by Chairman Boscove. It was decided the proposed January
28th Public Hearing would be cancelled at this time; a Workshop Meet-
ing to discuss changes in the Comprehensive Plan will be held Feb-
ruary 11, 1975, at 7:30 P.M., to be immediately followed by the Regular
• Planning Commission Meeting.

ADJOURNMENT
Mr. Johnson offered the motion to adjourn the meeting, Mr. Potere
seconded the motion. The vote to adjourn being unanimous, the
meeting was adjourned at 9:30 P.M.
