1974.10.17_PB_Minutes_WorkshopATTACHMENTS - "A", "B", "C", "D". , MINUTES: PLANNING COMMISSION - WORKSHOP MEETING - BOCA HI - OCTOBER 17 1974. • Chairman Kemery called the meeting to order at 7:30 P.M. Present: Chairman Kemery, Messrs. Boscove, Johnson and Genovese. Absent: Mr. Wilcox, Mr. Schober Chairman Kemery, reading from the Agenda (Attachment "A"), noted this meeting, a Workshop Meeting is held to discuss the letter received on September 9, 1974, dated September 5, 1974, from Mr. Richard B. Rodgers, (Attachment "B"). Reference was made to letters sent to Boca Hi, Inc., dated 9/26/74, and received at 550 Grant Street, Pittsburgh, Pa., and 4720 South Ocean Blvd., Highland Beach, Florida. (Attachment "C", with copy of signed receipt). The Chairman then inquired as to whether Commission members were interested in viewing the Site Plan at this time. It was the consensus that all had previously done so. Addressing the audience, Chairman Kemery asked for comments or questions. There were none. •Stating that a telephone call received from Mr. William Johnson, on Tuesday, October 15, 1974, 12:30 P.M., at the Town Hall, Highland Beach, conveyed the message that Mr. Johnson and Mr. Rodgers would be unable to attend the Workshop Meeting scheduled for 7:30 P.M., October 17, 1974, Chairman Kemery then read the letter of confirmation from Attorney David B. Dickinson (Attachment "D"), dated October 16, 1974. Chairman Kemery noted this letter constituted sufficient evidence there would be no representative of Boca Hi present at the Workshop Meeting on October 17, 1974. Mr. Genovese, reading from Section 13.3, of the proposed Zoning Report (Public Hearing Before Planning Commission; Action Following Hearing), noted that failure of the Planning Commission to report within 90 days after the Public Hearing (unless a longer period has been agreed upon by the Town Commission) shall be deemed approval by the Planning Commission. In addition, Mr. Genovese referred to Section 13.4, and advised he was in agreement with the text, but felt it incumbent to say, in the event the matter of a question were to arise and be put to a vote, he would neces- sarily abstain from voting since he had purchased property from Boca Hi, Inc. Mayor Gilday in audience recommended sending a letter to the petitioner expressing sympathy for Mr. Rodgers who is ill and a willingness to •afford ample opportunity to Boca Hi to meet with the Planning Commission at a future date for a Workshop Meeting. A lengthy discussion followed, relative to the time limitations applic- able to petitioners postponement of meeting with the Planning Commission. At this point, Chairman Kemery inquired if anyone in audience wished to voice an approval of the proposed Boca Hi Plan or express opposition to same. There were no comments from the audience. Mr. Boscove suggested following the advice of Mayor Gilday, with regard to scheduling a Workshop Meeting with Boca Hi representatives in three weeks time. The matter of the correspondence received from Boca Hi was reviewed, i.e., 7/8/74 - Boca Hi letter requesting hearing an application. 7/19/74 - Planning Commission letter advising Boca Hi of meeting scheduled for August 2, 1974. 8/2/74 - Preliminary plans submitted by Boca Hi. These plans approved by Planning Commission, subject to delivery of preliminary plans for units East of AlA. Town Attorney noted approval of plans submitted is not intended to be interpreted as approval of the Eastern Units. • 9/9/74 - Plans presented with letter of September 5, 1974, to J. O'Grady at Town Hall. Mr. Boscove, reading from Section 13.1., paragraph two, indicating the Planning Commission shall set a date for a public hearing upon acceptance of the application of petitioners, pointed out that there was no basis for setting a date for Public Hearing at this time. Colonel Hauck, in audience, spoke relative to Boca Hi and RPUD projects on the East and West sides of AIA and recommended 30 day notice be given the petitioner to take action in good faith or take the position of a new de- veloper. Chairman Kemery thanked Colonel Hauck. Mr. Boscove offered the motion to set another date for a Workshop Meeting with Boca Hi, Inc. Mr. Johnson seconded. Mr. Genovese recommended that an amendment be made to the letter to be sent to Boca Hi with an admon- ition that time is of the essence and in the event of a failure on the part of Boca Hi as a corporation to prosecute their petition by an officer ATTACHMENTS - "A", "B", "C", "D". The vote was polled, Mr. Genovese, Mr. Johnson, Mr. Boscove and Chairman Kemery voted Aye. Mrs. Stewart in audience asked if thirty days notice given started from this date. Mr. Boscove suggested the Workshop Meeting be held together with Regular Meeting of the Planning Commission scheduled for Thursday, November 21, 1974, at 7:30 P.M. Mrs. Stewart, in audience, noted that a C.A.B. Meeting is scheduled for November 21, 1974. Mr. Boscove moved to adjourn this Workshop Meeting, Mr. Genovese seconded and the motion to adjourn was unanimously carried. The Workshop Meeting was adjourned at 8:25 P.M.
