MINUTES: PUBLIC HEARING OF THE PLANNING BOARD - AMENDMENTS OF THE
COMPREHENSIVE PLAN AND THE ZONING ORDINANCE WITH RESPECT TO
• DENSITIES ETC. RECESSED MEETING FROM APRIL 25, 1974
Chairman Kemery called the Public Hearing of the Planning Board to order
at 2:00 P.M. on May 2, 1974. This meeting is a continuation of the
Public Hearing on re -zoning that was started on April 11, 1974.
Present: Chairman Kemery, Dr. Guelzow, Mr.
Johnson, Mr. Wilcox and Mr. Boscove
also present were Mr. Vern Foster, Zoning Official, Ms. Elaine Roberts,
Town Administrator and residents from the Town.
Chairman Kemery stated that the one item which was not consummated was
the one regarding RM 1 and RM IA - Highland Beach Isles. Mr. Boscove
reviewed what was done at the last meeting and it was decided to change
the side setbacks, and also form a new district of RM 1A, formerly
RM 1. The RM lA district is shown on the map as Highland Beach Isles
Subdivision. The setbacks were changed there to 15 ft. for two (2)
story buildings and 12 ft. for single story buildings. Mr. Boscove
did some calculations based on this matter and explained that if they
were to take advantage of the 12 ft. setback they cannot put a building
there to conform with the open space requirements as set under the LUI
figures. A solution to this problem in RM 1 and RM IA, would be to
• eliminate the LUI system of calculating open space requirements and
adhere strictly to the setbacks and also set a maximum of 11 units
per acre in this district. Based on five (5) typical size lots in
the area, this would work out to what was agreed to cf three (3)
units per lot on lots west of A-1-A, and four (4) units per lot facing
A-1-A, and using that criterion decent size apartments anywhere from
1350 to 2000 sq. ft. per apartment could be built. We can cover
approximately 54/ open space of the ground area with buildings in-
cluding parking area, this is within our criterion of open space,
and also accomplishing what we intended to do at the last meeting of
giving the owners some relief by allowing decent size buildings without
cluttering the landscape. Mr. Boscove proposed that the LUI system
of calculating open space and other requirements be eliminated in RM 1
and RM 1A. Set a maximum of 11 units per acre in RM 1 and RM IA. In
combining two (2) lots together we have previously set a maximum of
120 ft. of length in building. If we leave it stay as is, we cannot
take advantage of a 12 ft. setback on a single story building, so I
propose that we increase the length of the building to 150 ft. on
one (1) story buildings so that we can take advantage of the side
setbacks, and with two (2) lots together with 150 ft. length building
you have a 50 ft. setback (25 ft. on each side). Discussion followed.
• Mr. Boscove made a motion, seconded by Mr. Wilcox to change RM 1 to
RA 1, RM lA to RA 2, and eliminate the LUI system of open space and

other requirements (Highland Beach Isles will be RA 2 and Bel Lido
RA 1) with maximum units of 11 per acre. All members agreed.

(Boca Hi north RM 3) The other item is the land area west of A-1-A
that is presently RM 30, change to RM 2A, LUI 54 maximum 20; RPUD
maximum 25. Change south
district from RM 3 to RM 2A,including Aberdeen Arms. RPUD 2, if
ever cancelled should revert to 2A and not 3.
Mt. Totz, stated that if RM 3 is rezoned to RM 2A with 20 units, Mr.
Urbanek would raise an objection on lots 93 and 94, the cut is too
drastic, that is a 33/ cut. Dr. Guelzow inquired the date of acqui-
sition of lot 94. Mr. Totz did not know the date and was told that
it is important to know the date.
Mr. Boscove made a motion, seconded by Dr. Guelzow that all the
proposals, and our recommendation for the changes regarding the
Comprehensive Plan and Zoning Ordinance be sent to the Town Commis-
sion for their adoption. This was agreed by all members unanimously.
Dr. Guelzow made a motion, seconded by Mr. Johnson to adjourn this
meeting.
Meeting adjourned at 3:15 P.M.

Chairman Kemery called the regular meeting of the Planning Board to order at
3:35 p.m. on May 2, 1974. This meeting has been prosponed from April 18,
1974.
Present: Chairman Kemery, Dr. Guelzow, Mr.
Boscove, Mr. Johnson and Mr. Wilcox
Chairman Kemery gave a review of the minutes from the regular meeting of March
21; Workshop meeting of March 26; Workshop meeting of April 4; Public Hearing
meeting regarding Oliver Hoffmann Corporation of April 4; Workshop Meeting of
April 4, 1974 and the Public Hearing meeting regarding Amendments of the
Comprehensive Plan and Zoning Ordinance of April 11, 1974. All minutes were
approved, but a correction to made on the minutes of April 11, 1974 regarding
Zoning Ordinance, which will be made.
It was suggested that an Applicant for RPUD or Zoning change should present
all material, legal description and survey signed and with a seal a week be-
fore the Planning Board Meeting. All members agreed.
Mr. Wilcox made a motion to adjourn, seconded by Mr. Boscove.
